Terms of Service

These Terms govern use of the Sweet Oaks website and online services. Separate checkout disclosures, refund or cancellation terms, fundraiser program terms, and signed waivers also apply where presented. If a separate signed agreement conflicts with these Terms, the separate agreement controls for that subject.

1Agreement and eligibility

By accessing sweetoaksbakery.com or using an online Sweet Oaks service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and legally able to enter a contract to create an account, place an order, sign a waiver, book a party or event, purchase a membership, submit an application, or administer a fundraiser. When acting for a child, organization, or another person, you represent that you have authority to do so.

2Accounts and security

  • Provide accurate, current information and keep account credentials secure.
  • You are responsible for activity performed through your account unless caused by our failure to use reasonable security.
  • Notify us promptly of suspected unauthorized access.
  • We may suspend access reasonably necessary to investigate fraud, protect users, enforce these Terms, or comply with law.

3Orders, pricing, and payment

Product availability, preparation times, pickup or delivery options, taxes, fees, and prices are shown during checkout and may change before an order is submitted. An order is accepted when payment is approved and we provide confirmation. We may cancel and refund an order that cannot be fulfilled, contains an obvious pricing error, appears fraudulent, or violates these Terms.

Square securely processes online payments. Sweet Oaks does not receive or store the full payment-card number. You authorize the displayed charge, including applicable tax, tip, delivery fee, or other amount you approve at checkout.

Food photos are illustrative. Ingredients and availability may vary. Customers are responsible for communicating allergy concerns directly to the store; our kitchens handle common allergens and cannot promise an allergen-free environment.

4Refunds, cancellations, and delivery

Refund and cancellation eligibility depends on the product or service and any terms shown at purchase. Perishable or customized goods may not be refundable after preparation begins except where required by law or where we fail to provide the purchased item. Party and event deposits, cancellation windows, rescheduling, and damage terms are disclosed during booking.

Pickup, delivery, campaign-distribution, and event times are estimates and may change because of volume, weather, safety, supply, or circumstances outside reasonable control. Contact the fulfilling location promptly about a missing, incorrect, or damaged order.

5Memberships and recurring billing

A Play Pass or other subscription renews and is charged on the schedule and at the price disclosed before purchase until canceled. You authorize Square to process recurring charges using the approved payment method. You may cancel future renewals through the dashboard or by contacting us. Cancellation stops future renewal and does not retroactively refund a completed billing period unless required by law or expressly stated otherwise.

Membership benefits, child limits, discounts, location access, and usage rules are those displayed for the selected plan and may be updated prospectively with legally required notice.

6Children, play areas, waivers, and safety

  • Sweet Oaks is not a drop-off childcare facility. A responsible adult must supervise children and follow posted staff instructions, age limits, capacity limits, and facility rules.
  • A parent or legal guardian must complete required waivers and provide truthful child and emergency information before participation.
  • Participation in physical play involves inherent risks. The separate waiver presented for signature describes the applicable acknowledgment of risk, release, emergency authorization, and other facility terms.
  • We may refuse or end participation when reasonably necessary for safety, suspected illness, disruptive conduct, rule violations, or facility capacity.

Nothing in these Terms replaces or expands a signed waiver, and nothing attempts to waive rights or liabilities that cannot lawfully be waived.

7Fundraising services

Fundraiser applications are subject to review and are not guaranteed approval. Approved organizers must provide accurate organization, participant, guardian, and distribution information; obtain parent or guardian authorization before adding a minor; protect private links and QR codes; and use purchaser information only for campaign administration and fulfillment.

Campaign dates, eligible products, internal contribution calculations, adjustments, refunds, payout holds, and payout method are governed by the fundraiser program terms confirmed with the organization. Public campaign pages are promotional storefronts and do not display private contribution rates, goals, balances, or guardian contact details.

Purchases support the named campaign but are purchases of goods—not charitable donations—and are not represented as tax-deductible. Unless Sweet Oaks expressly states otherwise, Sweet Oaks does not determine or guarantee an organization’s tax-exempt status.

8Gift cards and promotions

Gift cards, discounts, promotional offers, and daily specials are subject to the restrictions displayed with the offer and applicable law. They have no cash value except where required by law, may not be resold or used unlawfully, and may be canceled if obtained through fraud. Lost or stolen codes may be replaced only when ownership and remaining value can be reasonably verified.

9Electronic communications and signatures

You consent to receive transactional communications electronically at the address or number you provide, including receipts, account notices, booking updates, fundraiser information, and legally required disclosures. Transactional messages are not marketing subscriptions.

Where an electronic-signature disclosure is presented, selecting the acceptance box and typing your name constitutes your electronic signature. You may request a paper copy by contacting us. Marketing email, if offered in the future, will be optional and will include a lawful unsubscribe method.

10Acceptable use

You may not:

  • Use the service unlawfully, fraudulently, deceptively, or to harm another person.
  • Access another person’s account, private fundraiser link, order, or personal information without authorization.
  • Interfere with security, probe for vulnerabilities, introduce malicious code, scrape at unreasonable volume, or evade access controls or rate limits.
  • Submit content that infringes rights, is defamatory or abusive, or contains personal information you are not authorized to provide.
  • Misrepresent affiliation with Sweet Oaks or use our service to solicit unauthorized payments or donations.

11Content and intellectual property

The site, branding, designs, text, software, photos, and other Sweet Oaks materials are owned by Sweet Oaks or its licensors and protected by applicable law. These Terms grant only a limited, revocable, nontransferable right to use the service for its intended personal or organizational purpose.

You retain ownership of content you submit. You grant Sweet Oaks a limited license to host, reproduce, and use that content only as reasonably necessary to provide, secure, and administer the requested service. You represent that you have the rights and permissions needed to submit it.

12Third-party services and links

The service relies on providers such as Square and Clerk and may link to third-party sites. Their services may be governed by separate terms and privacy notices. We are not responsible for an unrelated third party’s content or conduct, but we remain responsible for our own obligations and vendor selection as required by law.

13Disclaimers

To the fullest extent permitted by law, the website and online features are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, that every product will remain available, or that estimated times will be exact. This disclaimer does not limit express promises made at checkout or rights that cannot legally be disclaimed.

14Limitation of liability

To the fullest extent permitted by law, Sweet Oaks and its owners, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the online service. For a claim arising solely from an online purchase or service, aggregate liability will not exceed the amount paid for the transaction giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by liability that cannot be limited, statutory consumer rights, or any other liability that applicable law does not permit us to exclude or limit.

15Indemnity

To the extent permitted by law, you agree to defend and indemnify Sweet Oaks from third-party claims caused by your unlawful misuse of the service, your material breach of these Terms, or content or personal information you submitted without authority. This does not require indemnification for Sweet Oaks’ own negligence or misconduct.

16Governing law and disputes

Kentucky law governs these Terms without regard to conflict-of-law rules. Before filing a non-urgent dispute, each party agrees to send written notice and make a good-faith effort to resolve it for 30 days. Any court proceeding must be brought in a state or federal court with lawful jurisdiction over Sweet Oaks and the dispute. Either party may seek relief in small-claims court when eligible or immediate injunctive relief when necessary.

These Terms do not require arbitration and do not waive a right to a jury trial or class proceeding.

17General provisions

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Sweet Oaks may assign them with a business transfer or by operation of law. Section headings are for convenience.

We may update these Terms prospectively. The updated date will appear above, and material changes will receive additional notice when required. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
